Under attack!

Ranbaxy won’t be affected much

Daiichi’s acquisition of the Indian Pharmaceutical giant Ranbaxy Laboratories Ltd. has stirred the hornet’s nest in the pharma industry.Ranbaxy won’t be affected much And the talks about the deal haven’t even died down when Ranbaxy has to face yet another glitch in the form of adulteration charges in its drugs from the US authorities: the Food and Drug Administration and Department of Justice. Ranbaxy’s stock faced a severe knocking since, falling by 18% to Rs.437 as on July 18, compared to Rs.538 on July 10, when the controversy broke.

It was a foregone conclusion that Big Pharma would not be happy with the deal, which merges a generic giant with an R&D major. But the matter became more complicated due to the statement made by Malvinder Singh, Chairman & CEO, Ranbaxy, to the press on July 18, when he said, “All these issues have emerged after the deal with Daiichi Sankyo... an MNC is trying to derail Ranbaxy’s deal with Daiichi Sankyo.”...Continue

A few months ago, a research done by the most prestigious Yale University revealed that Indian politicians are extraordinarily intelligent. Well, we should mention they prove to be equally intelligent as ‘fund’ (or should we say, ‘post’) managers to have learnt how to arrange ministerial portfolios to minimise political risk.

Some months ago, when UPA coalition partner, DMK leader Karunanidhi, called back Minister of Communications and IT, Dayanidhi Maran, who was replaced by another party loyalist and Environment Minister A. Raja without any stated specific reasons, even the Prime Minister had no say on it. And Minister of State for Home, S.Rogupathy, another loyal DMK leader, was brought to the Environment Ministry. Similarly, in the era of the NDA government, Suresh Prabhu, who was the then Power Minister, was also forced to leave the Ministry and was replaced by another party leader Anant Geete, a protege of Shiv Sena Chief Raj Thakeray.....Continue

Reliance initiative focuses

The new Reliance initiative focuses on the franchising model for their rural initiatives, by hiring agencies and professionals that are active in rural areas to rewrite the rules of the game. Reliance plans to scan over 100,000 people in 5,000 towns and identify 10,000 franchisees (for handling their internet based kiosks) over the next one year, to enable its customers to trade in equity, commodity, MFs and IPOs. But if you believe that rural area is the only area and mutual funds and insurance are the only products that Reliance Money is up to, you are perhaps underestimating the might of the company that has always played on price to conquer market shares. Brokerage is one area where Reliance is fighting with established players of the industry like Indiabulls, Share khan, ICICI Direct, Motilal Oswal et al. Reliance Money took the brokerage industry with storm by announcing an innovative pre-paid system for stock market brokerage. While the industry average of brokerage comes to around 15-25 paise for a Rs.100 deal, Reliance Money is ready to offer the same at 7.4 paise, a massively discounted rate from the rates being currently charged by institutional and individual brokerages.

HERO HONDA

They’ve moved up two notches from our last year rankings. Here’s why...

Despite intense competition from arch rivals, Bajaj Pawan Munjaland TVS, Hero Honda (HH) is today the world’s largest motorcycle maker in terms of volumes, with over 39.76% market share in India. Their strategy: to stay keenly focussed on the executive and entry level bike segments. In the last financial year, HH launched 8 products (New Karizma, GlamourFI, CD Dawn, et al) across segments. HH also made an important move by re-launching its CBZ brand. But, this company that first tasted success with its ‘fill it, shut it, forget it’ campaign, remainsHero Honda far too focussed on the affordable segments. (HH is still a distant fourth when it comes to the premium segment). According to auto expert Tutu Dhawan, “HH is happy being an executive segment player, they don’t see much rational as a premium segment player.” Even in the executive segment, Bajaj and TVS are giving it tough competition. But Hero Honda is not giving up. Despite a poor growth of 11% in FY07 (as opposed to a sector growth of 13%), its Karizma is not about to disappear anytime soon. You don’t become number one for nothing, but hey, there is danger lurking in your backyard dude!

Let’s go on a drive together

According to German weekly news magazine Wirtschaftswoche, BMW and Mercedes, two high-end luxury car brands owned by DaimlerChrysler, are getting ready to drive down the path of “cooperation”. The magazine quotes Michael Ganal, BMW sales and marketing chief as saying that both brands are in the luxury segment, they both are high-tech, they are both independent but they are not the biggest car makers, and that “Cooperation is a good approach…” since it allows “each group its freedom”. Although he did not quite specify in which areas BMW and Mercedes plan to cooperate, the general impression derived was that an effort to collaborate would help both brands. Already, the two car companies collaborate with General Motors to develop hybrid cars.

Let’s bow down to SEBI in shame!

Well, that must be an exaggeration, right? How could SEC (through the Corporate Fraud Task Force; July 26, 2007 data) tout 1,236 final convictions in the past five years, while SEBI have very few? Shamefully, the fact is that not only does SEBI have less than a handful of convictions annually to boast of, but also that even the number of investigation cases being completed has declined by a massive 55% (from 179 in 2005 to a pathetic 81 in 2006), & that too when all indices are rocking up to historical highs!

Be it the IPO scam, wherein SEBI issued interim orders against Indiabulls & Karvy, or be it the decision to ban Ketan Parekh, or the promoters of Adani Enterprises from entering capital markets, due to the utterly shallow prosecution procedures of SEBI, firms have found it too easy to get stays on orders issued by the regulator (On July 14, 2007, SEBI suffered another of the by-now-familiar nose cuts when Securities Appellate Tribunal – SAT – set aside SEBI’s order against Adani).

The global production of wheat has declined from 630 million tonnes to 600 million tonnes.

If you thought that was it, relax, the story doesn’t end here. Sowing the seeds for another mega scam, the government – ostensibly in order to maintain its reserve stocks (and bending to WTO pressures) – World Wheat Productionis going ahead and importing wheat at the rate of Rs.1,680 per quintal, when adequate wheat, costing Rs.800-1,000 per quintal is clearly available with the farmers. Numbing is the 27th report of the Parliamentary Standing Committee on Agriculture released in May 2007 that exposes the fact that government subsidies fail to reach 90% of the nation’s farmers. The government has also incurred the standing committee’s wrath for successfully subsidizing the most inefficient rural electricity boards, fertilizer and oil companies.

Even to say that India’s agriculture sector is going from bad to worse now sounds an unintellectual diatribe, repeated oft by almost everybody. But think about this – on July 18, 2007, Noble laureate (and Padma Vibhushan title holder) Norman Borlaug, regarded as the true father of the Green Revolution in India, Pakistan and Mexico, was awarded the US Congressional Gold Medal for his lifetime crusade to beat world hunger. The same Borlaug commented definitively that a second Green Revolution in India is just “not possible.” Dear Mr. Prime Minister, where in heavens do you see the Green in our revolution anymore? Pray, tell...

Hollywood digital movies can be shown only on DCI compliant platform

Indeed, that involves a huge investment on the part of UFO Moviez. Sample this: they are investing Rs.1.5 million per screen and adding 60-80 theatres every month, which means they’ve already invested Rs.1.13 billion in digitising theatres with Rs.90-120 million of additional investment every month. And so far, over 350 movies, aggregating around 350,000 shows have been played on UFO, earning revenues of around Rs.175 million, so there’s going to be quite a while before UFO can start churning out money. But the objective, as Kanwar reiterates, was to scale up, & fast. UFO has received VC funding of $23 million from 3i Group.

Working as it does on the bottoms up principle, UFO is becoming a rage in Class B & C centres. Having been constantly riled by the piracy malady, production houses including the most successful ones like Yash Raj Films & Filmkraft Productions are supporting this technology. But in cities, quite some theatres, particularly multiplexes like PVR, Fun Cinemas, Adlabs et al have refused to play ball. Then, the ‘shark’ effect has also been felt in India. Says Sathyam (a multiplex in the South that uses DCI technology) COO Tan Ngaronga to B&E, “Quality of image & sound (in DCI) is far superior than any other technology that is developing in India so far... (also) Hollywood digital movies can be shown only on DCI compliant platform...”

Raping the future, on their own???

Ask any malnourished, starving or a bonded girl child & she would plead that it is better to have a life like this than to be raped.

Hence; in 21st century, modern Rapecivilizations no longer belong to the gentle. On the contrary, it is a society of ignominy, shame or dishonour where even children can’t sleep peacefully. South Africa, better known as ‘The rape capital’ of the world has one of the highest incidence of child rape cases in the world. According to government statistics, 20,000 children are raped every year. At least 50 face such fate every day. Shockingly, a young African has greater chance of being raped than being educated. Yet it’s not just Africa alone. The state of Colorado in the US has experienced one in four women raped or harassed. National violence against women survey in the US in 1998 stated that more than 6.8 million women are victims of rape of which 29.3% are children. An Equity Employment Opportunity Commission (EEOC) study revealed 15,000 cases of sexual harassment is registered in the US annually. American Association of University Women (AAUW) survey in 2002 revealed that 83% of girls have been sexually harassed, & 78% of boys have been sexually harassed from 8th to 11th grade. The worldwide sexual assault statistics by George Mason University states that in Peru, South America, 90% girls (aged 12 to 16) who gave birth, from pregnancy due to rape.

US as the “strategic balancer” in Asia-Pacific

No points for guessing that this project slated to begin construction by end-July is opposed by the US and funded by Iran (National Iranian Oil Company or NIOC is one of the chief financiers of the project costing 50 billion Ringgit or US$14.5bn). China palpably is happy, since Beijing neither can nor does it intend to challenge the US supremacy at sea, thus it is busy aiding such pipeline projects (Gwadar port in Pakistan & Myanmar’s pipeline project from Sittwe to Kunming, capital of Yunnan Province) to ensure the smooth flow of hydrocarbons from the Gulf. Interestingly, Japan too has shown interest in the Malaysian project and is also one of its financiers, along with Saudi Arabia. “Despite the political equations with the US, Tokyo’s strategic energy demands ensure that it supports all initiatives which help it to secure its crude supply-chains”, said Dr. Vijay Sakhuja of the Institute of Southeast Asian Studies, Singapore, in a chat with B&E. The Malaysian initiatives are a cause of concern for Singapore. As Dr. Sakhuja says: “Should the proposed Malaysian mega-project reach its fruition, which it would (given that there is both domestic political & international financial support) and will have an impact on Singapore’s dominant position as Asia’s frontrunner in trans-shipment in Asia.”

The moral of the story is that while the US is busy flaunting its military muscle to secure its economic interests across the globe, others are quietly and diplomatically inching ahead to replace US as the “strategic balancer” in Asia-Pacific.

“The great eventful Present hides the Past; but through the din of its loud life, hints and echoes from the life behind steal in”

It is more of a certainty that Pakistan’s misanthropic misadventure would increasingly spread its fangs much beyond the paradigm of Kashmir to all over India. And it is a bigger certainty that in the new game, Bangladesh would be the new pawn, making sure that for India, internal security becomes much more of a concern than external threats.

Reaping the benefit of this increasing animosity towards India is China, which has its own compulsion to see much of India burning in a slow yet lethal proxy war. On one hand, while it has otherwise maintained a so called peaceful stance, on the other hand, it has been consistently handing over to Pakistan vital nuclear and missile technology to continue to keep India busy. So the elephant, which has not yet fully awakened from the slumber, finds itself surrounded by adversaries armed with lethal arsenal. Under such circumstances, a proposition to not arm her own self – just for the sake of pleasing the peaceniks – is nothing but self defeating. So a nuclear India has embarked on a new mission to continue with its missile development programmes to makes sure that some of them like Agni-III can reach the heart of China.

‘War of Terror’?

What lay behind the hysteria, of course, was the prospect that for the very first time one of the people who tricked America into war, then endangered national security yet again in the effort to cover their tracks, might pay some price. But Ajami need not have worried.

Back when the investigation into the leak of Valerie Plame Wilson’s identity began, Bush insisted that if anyone in his administration had violated the law, “that person will be taken care of.” Now we know what he meant. Bush has not challenged the verdict in the Libby case, and other people convicted of similar offenses have spent substantial periods of time in prison. But Libby goes free. Oh, and don’t fret about the fact that Libby still had to pay a fine. Does anyone doubt that his friends will find a way to pick up the tab?

Targeting parents of growing kids, the ad suggests that they get an Airtel broadband connection to satisfy the ever-growing curiosity levels and thirst of children to gain knowledge. The power idea is to increase consumer base through its strong communication. The USP of the product is its high speed of 2 Mbps and its interactive features. Instead of going all corporate, the reward to the prospect involves kids. Good strategy, in this age of pester power! Do fish sneeze, while in water? How do they sleep? Just stay tuned in to Airtel and let the ‘connection’ do the answering for your kids!

It’s the price stupid

With every commodity getting personalised, how could education be left behind? E-tutoring, or teaching through the internet is fast evolving as a mode of personalised affordable education. Once considered ‘just another business model’, the interesting part is that studies have now shown that this industry is worth more than $8 billion dollar in US and growing at an exponential rate. One reason for this sudden growth is the fact that e-tutoring firms are providing services mainly to the US market at extremely competitive prices. These service providers are charging as less as $2.50 per hour. Compare this to the standard US tuition price rate, which is currently at $40 per hour. Creditably, these e-companies offer a gamut of subjects ranging from Geometry to Geography; and again, for all possible age groups. Some of these firms are now tapping the gargantuan Chinese market for providing English education via e-tutoring.

But then, apart from being ‘good business’, this model holds no hopes for increasing literacy in developing nations, because of ridiculously low levels of internet penetration – averaging 0.05%.

The ‘Real’ty world of cheaters!

To prevent this open loot, the Supreme Court recently issued a notice to the central and state governments seeking guidelines from them on the mass media advertisements carried out by real estate companies and builders. The Apex Court’s intervention was prompted by a public interest litigation (PIL) filed by NGO, Sanrakshak (the Protector).

The genesis of the problem lies in the fact that builders issue illicit advertisements stating that they have government approval for a particular real estate project. The seal of government approval often leads the gullible public to believe that project is genuine and that their money is going into safe hands (that too without proper paper-work!). Misusing media through larger-than-life pre-launch blitz, the real estate developers draw advance from the public for factitious ventures. After a certain time gap, these fl y-by night operators vanish into thin air siphoning off millions with impunity. “These pre-launches sometimes are corporate frauds masquerading as news items. Media must insist on a signed brochure stating what the touted features are, so that responsibility can be fixed. At present, if someone invests based on media reports, he is exposed, as later on the real estate operator can always suggest that the media got it wrong,” emphasised Harish Salve, a noted lawyer and former Solicitor General of India, while talking to B&E.

Apartheid?!?

Any Indian worker toiling in the deserts of any sub-Saharan country probably has as much love and respect for India as any Indian IT professional in the Silicon Valley. But then, the negatively biased behaviour of the Indian government towards this section of workers is clearly nepotistic. For example, the PIO (Person of Indian Origin) card has been reported to be easily accessible to any NRI migrant from the US, but quite impossible to attain for an Indian stationed in any African country.

“The judiciary has usurped the discretionary power vested with the legislature to protect the needy and the downtrodden”

This raises a pertinent question: Why is the tussle between the two important arms of the state taking an ugly turn? Who is under pressure and of whom? According to an international legal expert working for the government (speaking on conditions of anonymity), the “fault lies with the politicians who don’t enact laws before entering into international treaties, like the WTO. The result is that when these treaties begin to hurt the common man, the judiciary steps in an activist role.” Such an explanation shows that, it is the government, which is under pressure to undo all that it had undertaken during the nationalisation era. The political leadership seems to be in tearing hurry to join the liberalising ‘heard’ because they don’t intend to look laggards in a largely globalising world. This would obliviously mean that the Judiciary is taking up cudgels on behalf of the ‘aam aadmi’ (common man) and protecting him from the vagaries of markets. If this was true then the communists would certainly have stood behind the courts. Ironically, Brinda Karat, says “The judiciary has usurped the discretionary power vested with the legislature to protect the needy and the downtrodden.” But Abhishek Singhvi, a noted lawyer and Congress Rajya Sabha MP, told B&E that the current judicial activism “should not be seen in terms of class struggle.”
